
TERMS AND CONDITIONS
1. Introduction

These Terms and Conditions ("Terms") govern the use of the services ("Services") provided by D Johnson Mechanical Pty Ltd (trading as DSJ Diesel) By engaging our Services, you ("Client" or "Customer") agree to be bound by these Terms. If you do not agree with these Terms, you must refrain from using our Services.
2. Scope of Services

DSJ Diesel provides repairs, maintenance, and services for cars, utes, trucks, tractors, earthmoving and farm machinery. Our services include, but are not limited to:

Engine diagnostics, repairs, and maintenance

Electrical systems inspection and repair

Vehicle and equipment repairs including but not limited to, brakes, steering, suspension and fuel systems

Installation of equipment and accessories to vehicles or equipment

Consultation and advice on vehicle and equipment maintenance and troubleshooting
The scope of each specific service will be defined in the service agreement or invoice provided to you.
3. Estimates and Pricing

Estimates: We will provide, upon request, an estimate for services upon inspection of your vehicle or machine. For servicing, this will be when you have provided the registration and kms. This estimate will outline the expected labour, parts, and time required to complete the work. Please note that estimates are based on initial inspections/information provided and unforeseen issues may arise that could lead to changes in the final price.

Pricing: Our hourly rate is $110(excluding GST) for light vehicles and $145 (excluding GST) for medium and heavy vehicles/machines. We charge a $20 (excluding GST) consumables fee on all jobs. For jobs on site, we charge a $50 (excluding GST)fee and $1 per km travelled (one way). For jobs requiring waste disposal (including parts or oils) will incur a $10 waste fee. Any additional charges, including those for parts or materials, will be clearly communicated and agreed upon before work begins.

Changes to Estimates: If additional work is required beyond the original estimate, we will notify you before proceeding and obtain your approval.
4. Payment Terms

Payment Schedule: Payment is due upon receipt of invoice unless otherwise agreed upon in writing. For work that is progressive and takes an extended period, progress payments may be required. We accept payment via credit card, direct deposit, cash or buy now, pay later schemes such as Afterpay.

Payments made via visa or mastercard will incur a 1.8% surcharge on top of the invoiced price for works

Eligible ABN or ACN holders may apply to have a credit account of 7, 14 or 30 days, depending on the nature of their business and credit history. By agreeing to these terms, you authorise DSJ Diesel to perform the necessary credit checks on your business and understand we may reject requests for credit accounts to any ABN or ACN holder if we believe it is in the best interests of our business.

Late Payments: Any unpaid balances after 14 days will incur a 10% late fee annually, calculated monthly. In the event of non-payment, DSJ Diesel Diesel reserves the right to withhold the release of your vehicle/machine and or parts and is authorised to remove any parts that were fitted and remain unpaid.

Failure to Pay: Failure to pay may result in legal action, and a debt could be recorded against your name.

Refunds: Due to the nature of the services, all payments are non-refundable unless otherwise agreed in writing or are in regards to a fault in parts or workmanship.

5. Client Responsibilities

You agree to:

Review the Terms and Conditions before commencement of work

Provide accurate information regarding the condition of your vehicle or machine

Ensure that the vehicle or machine is accessible for inspection and repair, including providing access to any necessary areas of the vessel.

Inform us of any known issues or previous repairs that may affect the current work.

Make timely payments in accordance with the agreed-upon schedule.

6. Travel

Travel Time: We do not charge time for travel. Instead, we charge a one off payment of $50 and $1 per km (one way) travelled to the destination. This is not a fixed cost and may be subject to change depending on the location and distance travelled.

Non-refundable: Travel time charges are non-refundable and are separate from any other service or labour charges.

7. Warranty and Limitation of Liability

Workmanship Warranty: We warrant that all work will be performed in a professional manner and in accordance with industry standards. Any defects in workmanship will be corrected at no additional cost for a period of 1 months (or 1,000kms) from the date of service or repair, whichever comes first.

Parts Warranty: Any parts supplied by DSJ Diesel are covered by the manufacturer's warranty, if applicable. We are not responsible for defects in parts beyond the warranty period or for parts not provided by us.

Limitation of Liability: To the fullest extent permitted by law, DSJ Diesel is not liable for any indirect, incidental, or consequential damages arising from the use of our services, including damage to the vehicle/machine, engine, or personal property.

8. Risk and Safety
​
Diesel mechanics work with complex systems, and certain services may involve risks, such as engine operation, fuel systems, or electrical components. While we take precautions to prevent accidents and damage, you acknowledge that you are assuming responsibility for the vehicle/machines condition and safety during the time it is in our care.

Client Risk: You agree to hold DSJ Diesel harmless for any injuries, damages, or losses resulting from risks associated with the vehicle or machine, including mechanical failure, leaks, or electrical malfunctions that are not as a result of faulty workmanship.

Environmental Responsibility: We adhere to environmental regulations and will properly dispose of any hazardous materials in accordance with local laws.

9. Cancellation and Rescheduling

Cancellation by Client: If you wish to cancel or reschedule a service, please notify us at least 24 hours in advance. Failure to do so may result in a cancellation fee.

Cancellation by DSJ Diesel: If we need to cancel or reschedule due to unforeseen circumstances, we will notify you as soon as possible and make reasonable efforts to accommodate you.

10. Insurance and Liability

Insurance: DSJ Diesel carries liability insurance for the services provided. However, we strongly recommend that you carry your own insurance for your vehicle or machine and any potential damage that could occur during service or repairs.

Damage Liability: While we take all reasonable steps to protect your property, we are not responsible for pre-existing damage to your vessel, parts, or equipment.

11. Dispute Resolution

Any disputes related to the Terms and Conditions or services provided by DSJ Diesel shall be resolved through mediation or arbitration in Victoria, Australia. By using our services, you agree to engage in good faith efforts to resolve any conflicts before taking legal action.
12. Breakdown Call Out Requests

Call-Outs: Requests for breakdown call-outs after 5pm, on weekends, public holidays or during the holiday season may be subject to availability and additional fees.

Call-Out Fee: Extra charges will apply for emergency call-out requests made during the above mentioned periods. The fee will be subject to the type of vehicle, time and location. All fees and charges will be outlined and agreed upon in advance.

Payment for breakdown services must be made before work commences, unless previously agreed upon. If a client advises they want to pay with cash, then valid card details must still be provided, before DSJ Diesel attends the breakdown.

Scheduling and Availability: While we will make every effort to accommodate your breakdown request, holiday season service availability may be limited and we can't guarantee we will be able to attend breakdown requests.
13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Victoria, Australia, without regard to its conflict of law principles.
14. Severability
​
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
